Supreme Court Rules: FDA Cannot Regulate Tobacco Industry
The Supreme Court, in a surprising recent decision, has ruled that the Food and Drug Administration (FDA) has no jurisdiction in the regulation of tobacco products. In response to the 5 to 4 ruling, President Clinton is urging the Republican-controlled Congress to pass legislation to support current FDA controls on the sales and marketing of tobacco products to children. These laws date back to 1996, when sweeping changes to the marketing and sales of cigarettes were made in response to the Clinton administrations efforts . . .
