March 31, 2011 The Federal Trade Commission and the Department of Justice (DOJ) jointly issued a "Proposed Statement of Enforcement Policy Regarding Accountable Care Organizations (ACO) Participating in the Medicare Shared Savings Program." The Medicare Shared Savings Program represents a substantial change in Medicare policy by encouraging ACO member organizations to share information and coordinate patient care, which in the past was a trigger for antitrust enforcement actions by DOJ.
