Are All Those Cash Discounts Legal?

Following our recent piece, Do Cash Discounts Change Consumer Expectations? all members, we received a couple questions from OPEN MINDS Circle reader, who asked:
How are the hospitals not committing contract fraud with their insurance contracts? Don't those contracts specify that they not charge other payers (including their own contracted insured) differently than they are charged for the same service? More specifically, don't those same contracts hold the hospitals accountable to the co-pay/deductible schedule(s) stated in the contracts?
How is this not Medicaid/Medicare Fraud since they are charging some patients . . .
