M.D. et al., v. Perry

In March 2011, a class action lawsuit was filed against Texas Department of Family and Protective Services (DFPS). In M.D. et al., v. Perry, the plaintiffs alleged that DFPS violated the constitutional rights of children who have been in foster care for at least a year by routinely failing to either return them safely to their families or find them safe, appropriate, and permanent new families. The plaintiffs alleged that DFPS was failing to meet its legal obligation to ensure the safety, permanency, and well-being of all children in its custody.
