Gwinnett County School District et al., v Cox et al.

May 16, 2011  The lawsuit was filed by the Gwinnett County School District; it consolidated similar complaints filed in 2009 and 2010 by other local school systems. The plaintiffs challenged the constitutionality of the 2008 Georgia Charter Schools Commission Act because it violated the “special schools” provision of the Georgia constitution. On May 16, 2011, the Georgia Supreme Court ruled that only local boards of education in the state can open public charter schools and overturned a 2008 state law that authorized the creation of “commission charter schools,” a new type of state charter school.
