TRO Denial in KC v. North Carolina DHHS, et al., Regarding Medicaid Supports Determinations for Persons With Developmental Disabilities
July 12, 2011 On July 12th, the Eastern District of North Carolina court denied the plaintiffs request for a temporary restraining order (TRO) to block Piedmont Behavioral Health, a local management entity in North Carolina that manages state funding for mental health, substance abuse, and disability support services from continuing to use the Supports Needs Matrix system, a new service determination system. The lawsuit was filed on July 5, 2011 on behalf of four plaintiffs whose services were eliminated or reduced after assessment with the new system.
