July 19, 2011 A response in opposition was filed by the defendants in the Texas case, Steward, et al. v. Perry, et al., against a June 22 filing by the U.S. Department of Justice (DOJ) that opposed state's motion to dismiss. The motion to dismiss is still pending. The original complaint was filed December 20, 2010, on behalf of approximately 4,500 persons with developmental disabilities in Texas nursing facilities who are being denied the chance to live in integrated community settings.
