August 4, 2011 The plaintiffs, who provide residential habilitation program coordination services for certified family homes for persons with disabilities, sought to prevent the Idaho Department of Health and Welfare from changing how it contracts for the services. The court ruled that the state must wait to implement a contract that changes per diem reimbursement rates for certified family homes until the federal Centers for Medicare and Medicaid Services issues an approval for the new approach.
