On August 7, 2017, the United States Court of Appeals for the Ninth Circuit published this legal ruling. The three-judge panel reversed the district court’s summary judgment entered in favor of the Secretary of U.S. Department of Health and Human Services, and held that the HHS Secretary had wrongly approved California's request for a retroactive 10% Medicaid rate reduction for hospital outpatient services provided in 2008 and 2009. The panel said the approval was "arbitrary and capricious." The case was returned to the district court for further consideration . . .
