District Court Denial Of Texas Medical Board Appeal To 5th Circuit
On August 15, 2016, the Texas District Court denied the Texas Medical Board’s motion to certify the appeal after denying the motion to dismiss in June 2016. The motion was denied due to the board waiting too long to file the appeal. The Texas Medical Board had asked the court to consider the board’s position that it is a state agency, and therefore immune from an anti-trust complaint lodged by Teladoc in response to the board’s rules on telemedicine services . . .
