Ruling in California State Foster Parent Association et al., vs. California Department of Social Services
August 30, 2010 On August 30, 2010 the United States Ninth Circuit Court of Appeals ruled that the federal Child Welfare Act gives foster parents the right to foster care maintenance payments that cover the actual cost of providing housing, food, clothing, and other required aspects of care for foster children. However, the ruling did not order payment increases; it focused on whether or not the Child Welfare Act established an enforceable right to foster care maintenance payments that cover the actual cost of care.
