On September 13, 2017, the Supreme Court of the State of New York issued this appeals court decision for Andryeyeva v. New York Health Care, Inc. The decision upheld an earlier ruling that home care organizations must pay non-live-in on-site home care staff for all the hours they are on-site with the client. Home care organizations cannot refuse to pay home care staff for hours on-site that might have been spent sleeping or eating since the home care staff is on-call during those hours.
