Defendant’s Answer to First Amended Complaint of Boston Medical Center Corp. v. Secretary of the Executive Office of Health & Human Services

October 22, 2009 The Executive Office of Health and Human Services of Massachusetts (EOHHS) responded to a lawsuit filed by Boston Medical Center (BMC) and Boston Medical Center Health Plan, Inc.(BMCHP). The BMC/BMCHP lawsuit says the state's Medicaid reimbursement formula and Section 122 reimbursement for individuals in MassHealth, CommonwealthCare, and the Health Safety Net fails to adequately reimburse BMC for reasonable costs to provide safety net health care services. In its response, EOHHS says that BMC/BMCHP voluntarily entered into written agreements providing BMC a bound contract for payment in full according to established rates of rate . . .
