Justice Department Finds that Colorado Violates the ADA By Segregating People With Physical Disabilities In Nursing Facilities
On March 3, 2022, the U.S. Department of Justice (DOJ) found that that Colorado unnecessarily segregates people with physical disabilities in nursing facilities, in violation of the Americans with Disabilities Act (ADA) and the Supreme Court’s decision in Olmstead v. L.C. The investigation was completed due to "several complaints" regarding Colorado's compliance with the ADA.
The DOJ found that Colorado is violating the ADA by administering its long-term care system in a way that unnecessarily segregates individuals with physical disabilities in nursing facilities and places others with physical disabilities at serious risk of unnecessary institutionalization . . .
