On April 22, 2021, the Tennessee Justice Center, which is representing a group of Tennessee Medicaid beneficiaries, sued the U.S. Department of Health and Human Services (HHS), and the Centers for Medicare & Medicaid Services (CMS), over the January 8, 2021 approval of the TennCare Block Grant Waiver. The plaintiffs allege that the state and CMS failed to allow enough time to solicit public feedback, and that HHS exceeded its statutory authority when it authorized the block grant program as an “experimental waiver” for 10 years.
