December 27, 2011 The Department of Labor (DOL) proposes to revise the current Fair Labor Standards Act regulations with regards to the exemption for companionship services and live-in domestic services. The proposed regulations would limit the companionship exemption to companions employed only by the family or household using the services. Third-party employers, such as health care staffing agencies cannot claim the exemption. In addition, any work benefiting other members of the household such as housekeeping or laundry for other members of the household do not fit the description of the incidental duties of an exempt companion.
