Constitutional Analysis of Suspicionless Drug Testing Requirements for the Receipt of Governmental Benefits

An analysis of the constitutionality of any federal move to condition Supplemental Nutrition Assistance Program (SNAP) and Temporay Assistance for Needy Families (TANF) block grants recepients on drug test results. Lawmakers at both the state and federal level have expressed interest in requiring negative drug tests as an baseline eligibility requirement for all applicants for state and federal assistance programs for low-income individuals and families. This document analyzes the legality of suspicionless searches in light of the Forth Ammendment.
