DOJ v. Virginia; Judge Gibney Remarks From The Bench

On June 8, 2012, a federal district court judge conditionally agreed to grant final approval of Virginia's proposed settlement agreement with the federal Department of Justice (DOJ) to improve the provision of community-based services for persons with developmental disabilities. The judge requested three “tweaks:” clarify from whom consent must be obtained, clarify that training center residents cannot be discharged without consent and have the right to insist on staying in a state-operated facility, and add a provision directing Virginia to report deaths or injuries to former training center residents.
