Supreme Court Ruling On The Patient Protection & Affordable Care Act
June 28, 2012
The plaintiffs challenged the Patient Protection and Affordable Care Act of 2010 (PPACA) provision instituting an individual mandate that all United States residents obtain health insurance coverage starting in 2014 or pay a tax penalty. The court accepted the administration's argument that the mandate was a condition that triggered a tax. The court rejected the administration's arguments that the mandate was legal under the Commerce Clause and the Necessary and Proper Clause. The Supreme Court decision also upheld the PPACA provision expanding Medicaid eligibility to low-income non-disabled childless adults.
