Berge v. United States of America
July 26, 2012
On July 26, 2012, a federal judged ruled that the Department of Defense (DoD) policy on limiting Applied Behavior Analysis (ABA) therapy to active duty military members was arbitrary. The ruling will require DoD to cover ABA therapy for TRICARE Basic Program members. Prior to the ruling, ABA therapy was covered for active duty service members under the ECHO Program, but denied for retired services members under the TRICARE Basic Program.
