September 10, 2012
On September 10, 2012, New Mexico Human Services Department secretary released a letter to the United States Department of Health and Human Services. The letter was regarding the Medicaid provision of the Patient Protection and Affordable Care Act. The letter asked whether CMS would allow the state the flexibility to include individuals with incomes up to 100% of FPL in the Medicaid program while placing newly eligible individuals from 100% to 138% of FPL in the StateÂ’s Health Insurance Exchange.
