On September 4, 2012, the federal Department of Justice (DOJ) informed the Florida Agency for Health Care Administration (AHCA) that placing children with disabilities in nursing homes because community capacity was lacking violated the Americans with Disabilities Act (ADA). In this letter, the state responds to the DOJ allegations. The state has requested documentation and information on the children DOJ showed concern about.
