Massachusetts et al., v Centers For Medicare & Medicaid Services
The lawsuit was filed on June 29, 2026, by a coalition of 26 states. The lawsuit is co-led by California, Massachusetts, and New Jersey. They are joined by Arizona, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Kentucky, Maine, Maryland, Michigan, Minnesota, Nevada, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and Wisconsin. The states are challenging a recently released interim final rule that informs states how to identify Medicaid beneficiaries with illness and medical conditions that render them “medically frail,” which would exempt them from new federal work or community engagement requirements.
