The federal Centers for Medicare and Medicaid Services (CMS) released the notice to inform states about their options for implementing the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) in their Medicaid plans and Children’s Health Insurance Plan (CHIP) programs. The notice provides a brief legislative overview and addresses how CMS will determine compliance in plans serving children, plans operated by Medicaid managed care organizations, Medicaid alternative benefit plans, and plans targeting the Medicaid expansion population.
