CMS Letter To Pennsylvania DPW Regarding Concerns About Medicaid Behavioral HealthChoices Procurement

The Center for Medicare and Medicaid Services’ (CMS’) letter to the Pennsylvania Department of Public Welfare (DPW) outlines the two issues that CMS finds from analyzing the behavioral health contracts between the Commonwealth of Pennsylvania and 44 counties. CMS has determined that the arrangements between DPW and the counties are not openly procured, because the counties are given the right of first refusal to provide behavioral health services. CMS has identified two options for the state in this circumstance.
