Humana Inc. sued Farmers Insurance Group of Companies seeking repayment for medical care Humana provided to Medicare Advantage enrollees who had been injured in automobile accidents where the vehicle owners had coverage through Farmers Insurance. Humana provided care to its Medicare Advantage enrollees before it learned that Farmers was the primary payer. Under the Medicare Secondary Payer (MSP) system, Medicare is the secondary payer in such cases. The MSP system is intended to prevent cost shifting when another primary payer exists for a beneficiary’s care
