Lawsuit Challenging Ohio Medicaid Expansion Plans

On October 10, 2013, the federal Centers for Medicare and Medicaid Services (CMS) approved Ohio's Medicaid state plan amendment to expand Medicaid; the expansion was then approved on October 21, 2013, by the state legislative Controlling Board. The state plan amendment was submitted despite political opposition and without formal approval of the legislature. This lawsuit challenges the authority of the legislative Controlling Board to approve the Medicaid expansion.
