August 22, 2007 The lawsuit, Colbert v. Blagojevich, seeks class action status for all individuals with disabilities in the state of Illinois who seek to live in community-based settings. The plaintiffs are five individuals with disabilities who live in nursing homes across Cook County, Illinois. The lead plaintiff was admitted to an Oak Park area nursing facility in February 2006 after complications from surgery left him paralyzed on one side of his body and he started having seizures. The lawsuit seeks the following: Mandatory admission assessment and periodic assessments to determine if nursing home residents are eligible for community . . .
