Plaintiffs’ Request to Modify Brown v. Tennessee Settlement Agreement
January 2007 The plaintiffs' attorneys asked the Court to modify the June 15, 2004 Settlement Agreement in Brown v. Tennessee. They said that the modification is necessary because more than 800 persons on the waiting list for Medicaid waiver services, designated in the crisis category, are unable to receive services because the state (the defendant) has restricted enrollment into waiver services from a rate of 170 per month to 15-20 individuals per month. The plaintiffs sought to force the state to allow all individuals who have been in the "crisis" category for more than 90 days to receive services . . .
