Department Of Labor Decision & Order Re: Seneca Re-Ad Industries, Inc.

In this legal decision issued on February 2, 2016, a federal administrative law judge with the Department of Labor (DOL) ordered the Seneca County, Ohio, Board of Developmental Disabilities to ensure that three participants of its sheltered workshop receive minimum wage.  The order concerned Seneca Re-Ad, which contracts with the county board to provide employment for people with developmental disabilities .  The administrative law judge said Seneca Re-Ad was not able to prove that the three individuals’ disabilities kept them from accomplishing the work, and that as a result, they had no constraints on their performance; they were eligible . . .
