On September 15, 2016, the Idaho Department of Health and Welfare (IDHW) agreed to settle a class-action lawsuit, K.W. v. Idaho DHW, which was filed in 2012, and protested a new individual budget process implemented in July 2011 that linked the individualÂ’s budget to assessed needs and status to anticipated expenditures for home- and community-based services (HCBS). The settlement includes near- and long-term tasks; in the near term, IDHW must make immediate changes to protect participantsÂ’ due process rights; the long-term activities are to make systematic changes . . .
