American Health Care Association, et al. v. U.S. Department Of Health & Human Services, et al.

On October 17, 2016, the American Health Care Association (AHCA), a trade organization for the long-term care industry, sued the federal Centers for Medicare & Medicaid Services (CMS). AHCA is seeking to cancel a new rule that says nursing homes participating in Medicare and Medicaid cannot force incoming residents to give up their right to sue if a care dispute arises. In this complaint, AHCA says CMS exceeded its statutory authority and AHCA seeks to enforce its rights under federal law, including the Federal Arbitration Act (FAA), to enter into arbitration agreements . . .
