Memorandum & Opinion Ruling On Aetna Protest To Pennsylvania HealthChoices Procurement

On July 19, 2016, the Commonwealth of Pennsylvania filed this memorandum opinion by the Honorable P. Kevin Brobson regarding Aetna's protest to the procurement of provider contracts for Pennsylvania HealthChoices (Aetna Better Health of Pennsylvania Inc. v. Commonwealth of Pennsylvania, Department of Human Services). The opinion states concerns about the credibility of the procurement request for proposal (RFP), concerns that the Pennsylvania Department of Human Services' (DHS) intends to move forward with procurement despite the protest, and grants Aetna's preliminary injunction. The opinion further directs DHS to use a hearing officer with no connection to DHS or knowledge . . .
