December 15, 2009 The American Civil Liberties Union of Indiana filed the lawsuit on behalf of foster children and foster and adoptive parents after the Indiana Department of Child Services (DCS) reduced the foster care and adoption assistance per diem rate by 10% effective January 1, 2010. On January 20, 2010, a federal judge issued a preliminary injunction to block DCS from implementing the rate reduction.
