Jimmie v. Pennsylvania Department of Public Welfare Settlement Agreement
July 29, 2010 On December 1, 2010, a federal judge approved a class action lawsuit settlement in Jimmie v. Pennsylvania Department of Public Welfare (DPW). The lawsuit was filed in June 2009 on behalf of 115 people with mental retardation who reside in state psychiatric hospitals. The plaintiffs alleged that DPW was inappropriately housing people with intellectual disabilities and that the situation violated the Americans with Disabilities Act by segregating the plaintiffs unnecessarily and violated the 14th Amendment of the Constitution because DPW failed to provide constitutionally adequate treatment.
