August 23, 2010 The court ruled that the California Department of Social Services (DSS) cannot impose changes to caregiver qualifications for the In-Home Support Services (IHSS) program. DSS sought to change the qualification rules to match those for employees of nursing homes. Advocates for individuals receiving IHSS were concerned that the changes would create difficulty for those forced to find new caregivers. The proposed qualifications would have prevented people convicted of felonies and specified misdemeanors from becoming IHSS caregivers. State law has only prevented people convicted of child or elder abuse, or Medicaid fraud from becoming IHSS caregivers. Download . . .
