American Hospital Association, Et Al. v. U.S. Department Of Health & Human Services

On December 4, 2019, the American Hospital Association (AHA), Association of American Medical Colleges (AAMC), Children’s Hospital Association (CHA), and Federation of American Hospitals (FAH), two hospital health systems and one health center sued the U.S. Department of Health and Human Services (HHS). The lawsuit challenges two HHS rules (one final and one proposed) that require hospitals and health systems to disclose prices.

The finalized rule, “Hospital Outpatient Prospective Payment System (OPPS) Policy Changes: Hospital Price Transparency Requirements,” requires each hospital operating within the United States to establish, update, and make public a yearly list of the hospital . . .
