The Indiana Department of Child Services (DCS) agreed to establish a cost-based rate setting methodology for calendar year 2012 and members of the Indiana Association of Residential Child Care Agencies (IARCCA) agreed to accept a five percent per diem rate cut during calendar year 2011. The five percent rate cut also applied to private secure facility provider organizations that operate as psychiatric residential treatment facilities and to child placing agencies. IARCCA filed the lawsuit in 2009 after DCS announced plans to cut per diem rates as a budget . . .
