CMS Drops Challenge To Texas Medicaid 1115 Waiver
The Centers for Medicare & Medicaid Services (CMS) dropped its rescission of a contested Texas Medicaid 1115 waiver, which will allow the state to implement the Texas Healthcare Transformation Quality Improvement Program (THTQIP) waiver. CMS had initially approved the 10-year THTQIP waiver on January 15, 2021, just before the administration change of power. In April 2021, the Biden administration CMS revoked the approval because the Texas Health and Human Services Commission (HHSC) had not complied with a waiver approval process requirement to collect public comments. In response, the state sued.
