California Department of Insurance Amicus Brief Opposing Blue Shield of California Request for Rehearing of Harlick Appeal & Decision on Application of Mental Health Parity Law

November 11, 2011 The Commissioner of California's Department of Insurance submitted this amicus brief which supports the circuit court of appeals opinion in Harlick v. Blue Shield of California. The lawsuit concerned coverage of mental health treatment in residential settings. The appeals court said the state's mental health parity law requires health plans to cover treatment in residential settings—even when the plan benefits exclude coverage.
