New York Attorney General Settlement With UnitedHealth Group Regarding Nursing Home Contracting

This settlement was released on January 7, 2016 by the New York Attorney General’s office, and announces that the state has reached a settlement with UnitedHealth Group (United) related to provider network requirements for skilled nursing facilities (SNFs). The settlement states that United may not require SNFs to participate in United’s Medicare Advantage institutional special needs plan (I-SNP) as a condition of participating in United’s other insurance plans. Additionally, United may not penalize SNFs with lower reimbursement rates than similar SNFs if they decline to participate in the I-SNP.
