On January 8, 2016, the federal Centers for Medicare & Medicaid Services (CMS) advised state Medicaid plans that state plan amendments and waiver amendments to adjust rate methodologies for home- and community-based services (HCBS) to comply with new rules on wages and overtime for home care workers will be approved promptly so that the state Medicaid plan can avoid enforcement action by the Department of Labor (DOL), Wage and Hour Division.
