State Of Texas, Et Al., v. HHS
The complaint was filed on January 23, 2026, by nine states (led by Texas, and joined by Alaska, Florida, Indiana, Kansas, Louisiana, Missouri, Montana, and South Dakota) to challenge the May 2024 final rule on Section 504 of the Rehabilitation Act of 1973. The states allege that the integration mandate is unlawful and unconstitutional. The nine states are now asking the court to vacate the entire Section 504 rule issued in May 2024 as unlawful and to stop HHS from enforcing the rule.
