Behavioral health advocates filed the class-action complaint on behalf of New Hampshire residents with serious mental illnesses who are or are at risk of being institutionalized in state-run facilities due to the state's failure to provide community-based mental health services. The lawsuit was filed after eight months of negotiations between New Hampshire and the federal Department of Justice (DOJ) broke down in December 2011 regarding the adequacy of the stateÂ’s community-based service system.
