Federal HHS Response To Ninth Circuit Court Of Appeals Regarding Petitions For Rehearing & Rehearing En Banc In Managed Care Pharmacy v. Sebelius

The California Department of Health Care Services seeks to implement a 10% reduction in Medicaid rates, which was approved by a three-judge panel of the Ninth Circuit Court of Appeals. A lawsuit filed by provider organizations sought to block the cut, and after a series of appeals, the plaintiffs have now requested that the full Ninth Circuit Court of Appeals review the panel decision. This document is the response of the federal Department of HHealth and Human Services, which opposes another review.
