Findings Letter For United States’ Investigation, Under Title II Of The Americans With Disabilities Act, Of Colorado’s Use Of Nursing Facilities To Serve Adults With Physical Disabilities
The Department of Justice issued the letter on March 3, 2022, to the State of Colorado. The investigation took place from November 2018 through October 2021. The DOJ reviewed state records related to the long-term care system, its programs, policies, and procedures for transitioning nursing facility residents to the community. In this review, the DOJ found that the state was violating the Americans with Disabilities Act (ADA) and resident civil rights because community support capacity was insufficient to meet service needs of nursing facility residents with physical disabilities who wished to live in the community.
