Olivia Y Plaintiffs Memorandum of Law in Support Of Their Renewed Motion for Contempt Against The Mississippi DHS For An Evidentiary Hearing & For The Appointment Of A Receiver
On March 9, 2015, advocates for children in Mississippi’s child welfare system filed a motion asking the court to find the Mississippi Department of Human Services (MDHS) in contempt of the Olivia Y settlement agreement due to the state’s on-going failure to meet the terms of the agreement. In the motion, attorneys representing the Olivia Y plaintiffs asked U.S. District Judge Tom Lee find the state in contempt and to appoint a receiver to take over the child welfare system. A federal court trial on the contempt motion is scheduled to begin on August 10, 2015 . . .
