Memorandum Decision & Order In K.W., et al, v. Armstrong, Re: Idaho Developmental Disabilities Service Budget Litigation

On March 25, 2014, a federal District Court issued a new decision granting class action status to a group of combined lawsuits filed by adults with developmental disabilities (DD) protesting a change to service budget setting by the Idaho Medicaid DD Services program. As the lawsuit proceeds, the court ordered that the Idaho Department of Health and Welfare may not reduce or terminate DD services to Medicaid participants "as provided in the Individual Support Plans in place for each class member prior to July 1, 2011 . . .
