Disability Rights New York v. New York Department Of Health
On April 3, 2020, Disability Rights New York (DRNY) sued the New York Department of Health to ensure that people living in congregate care settings are considered priority recipients under the state’s “Ventilator Allocation Guidelines.” DRNY is requesting to immediately take the necessary steps to ensure that New Yorkers with disabilities have equal access to life saving health care.The "Ventilator Allocation Guidelines" can be used to prevent people with disabilities from obtaining ventilators simply because they have underlying conditions that may intensify symptoms and slow recovery . . .
