The appeals court ruling related to a class action lawsuit filed by Disabilities Advocates Inc., (DAI) against the state of New York on behalf of adults with mental illness living in adult homes, large congregate care facilities. DAI had a contract with the state as the Protection and Advocacy organization for individuals with mental illness to ensure state compliance with federal law. DAI prevailed in the class action lawsuit, but the state appealed on the grounds. The state said DAI lacked standing to sue. The appeals court agreed with the state, and ruled that DAI lacked standing . . .
